In a fiery session on Thursday, a senior member of the city Law Department faced intense scrutiny regarding the Adams administration's response to allegations of sexual harassment levied against retired NYPD sergeant Timothy Pearson, a senior mayoral adviser. Council Member Lincoln Restler spearheaded the inquiry, pressing the administration on why the Equal Employment Opportunity office seemingly halted its investigation into retired NYPD Sgt. Roxanne Ludemann's complaint against Pearson after she declined a formal interview.

Restler confronted managing attorney Eric Eichenholtz, questioning why the EEO office didn't pursue information from witnesses to gather a comprehensive understanding of the situation, considering the number of individuals aware of the alleged misconduct. Despite persistent questioning, Eichenholtz refrained from addressing specifics of the case.

Previous reports revealed that the city enlisted outside counsel to represent Pearson, despite the lawsuit implicating actions typically prohibited under city regulations. Ludemann's lawsuit, unveiled on March 22, initially prompted claims from the Adams administration that she refused cooperation, a narrative later refuted by evidence indicating her engagement with an EEO official on multiple occasions.

Ludemann, who served under Pearson in the Municipal Services Assessment unit, underwent questioning by the NYPD's Internal Affairs Bureau, along with her supervisor, NYPD Chief Miltiadis Marmara, highlighting the multifaceted nature of the investigation.

As Restler underscored, investigations into such allegations can proceed even in instances where the alleged victim opts not to participate fully. With potential witnesses, including high-ranking NYPD personnel, overlooked, questions linger about the thoroughness and impartiality of the inquiry.

Eichenholtz emphasized the city's obligation to provide representation for employees unless they violate regulations or act outside the scope of their duties. Restler, however, expressed skepticism, suggesting Pearson's taxpayer-funded legal support stemmed solely from his association with the mayor.

Elizabeth Garcia, a spokeswoman for the mayor, countered Restler's assertions, stating that an examination of Ludemann's claims within the lawsuit's framework is underway. Garcia criticized Restler for misinterpreting the timeline of events related to the retired sergeant's allegations, alleging his inaccuracies stemmed from a lack of comprehension of legal processes.

Despite the swirling allegations, Pearson seemingly maintains his position overseeing Municipal Services Assessment. "To the best of my knowledge, he continues to serve in his current capacity," remarked Eichenholtz.
